1.General
1.1. These Terms of Service (the "Terms") constitute a public offer and govern the relationship between the operator — a self-employed individual registered in the Russian Federation under the Professional Income Tax (NPD) regime, operating under the "Elysium Hosting" brand (the "Operator", "we"), and any person using the services (the "Client", "you").

1.3. By placing an order or using the services, the Client confirms acceptance of these Terms, the Privacy Policy, Refund Policy, Acceptable Use Policy and Fair Usage Policy.
2.Definitions
2.1. Service — rental of computing resources to host a Minecraft game server and related software.
2.2. Account — the Client's account in the client area.
2.3. Panel — the web server-management interface (Pterodactyl).
3.Formation
3.1. The contract is concluded upon payment of an order (acceptance of the offer).
3.2. The services are intended for persons who may lawfully enter into contracts under applicable law. Persons under 18 use the services with the consent of a legal guardian; processing data of children under 16 (Art. 8 GDPR) requires guardian consent.
3.3. The Client warrants that the information provided at registration is accurate.
4.Services
4.1. The Operator provides Minecraft game server rental. Plan scope and specifications are shown on the order page.
4.2. The service is supplied remotely over the Internet and is a digital service whose performance begins immediately after payment (with the Client's consent).
4.3. The Operator may engage third parties (data centres, payment providers) to perform its obligations.
5.Account
5.1. Registration is required. The Client must keep credentials confidential and is responsible for activity under their account.
5.2. The Client must promptly report any unauthorized account access to the Operator.
5.3. One Client uses one account unless otherwise agreed.
6.Prices & payment
6.1. Prices are shown in EUR and include applicable taxes. Payment is made in advance for the selected period (1, 3, 6 or 12 months).
6.2. Payments are processed via third-party providers, including crypto (NowPayments). The Operator does not receive or store card details.
6.3. The service activates upon confirmed receipt of funds. Prices may change; the price for an already-paid period is fixed.
7.Withdrawal & refund
7.1. EU/EEA consumers have a 14-day right of withdrawal (Directive 2011/83/EU). By ordering and consenting to immediate performance, the consumer acknowledges losing the right of withdrawal once the service is fully performed; before that, a charge for the part performed may apply.
7.2. RF consumers may withdraw at any time under Art. 32 of the Consumer Protection Law, reimbursing the Operator's actual costs.
7.3. Regardless of the above, the Operator offers a voluntary money-back guarantee — see the Refund Policy.
8.Client duties
8.1. The Client must use the services per the Acceptable Use Policy and Fair Usage Policy.
8.2. Using the services for unlawful activity, infringing third-party rights, hosting prohibited content, or in ways violating RF or EU law is forbidden.
8.3. The Client is solely responsible for content they host and for compliance with the Mojang EULA.
9.Availability (SLA)
9.1. The Operator targets availability of at least 99.5% per month, excluding scheduled maintenance announced in advance.
9.2. Backups run automatically, but the Client must keep their own copies of important data. The Operator does not guarantee data integrity against Client actions, third-party attacks, or force majeure.
10.Liability
10.1. Services are provided "as is". To the extent permitted by applicable law, the Operator's aggregate liability is limited to the amount paid by the Client for the last billing month.
10.2. The Operator is not liable for indirect damages (lost profit, data loss, downtime). This does not limit liability that cannot be excluded by law (including mandatory consumer rights).
11.Suspension & termination
11.1. The Operator may suspend or terminate services for breach of these Terms, non-payment, or upon a lawful authority request, notifying the Client where possible.
11.2. The Client may stop using the services at any time by deleting the server in the panel. Refunds for unused periods are governed by the Refund Policy.
12.Force majeure
12.1. Neither party is liable for failure caused by events beyond reasonable control (data-centre and backbone outages, DDoS attacks, government action, natural disasters, etc.).
13.Personal data
13.1. The Operator processes personal data under Russian Federal Law No. 152-FZ and Regulation (EU) 2016/679 (GDPR). See the Privacy Policy.
14.Changes
14.1. The Operator may amend these Terms. The current version is posted here with an update date; material changes are notified by email. Continued use means acceptance.
15.Law & disputes
15.1. These Terms are governed by the law of the Russian Federation. Disputes are settled by negotiation and, failing that, by the court at the Operator's location, unless mandatory consumer-protection rules provide otherwise.
15.2. These Terms do not deprive EU/EEA consumers of the mandatory guarantees of their country of residence. Such consumers may use the EU Online Dispute Resolution platform: ec.europa.eu/consumers/odr.
